本ご利用規約は、HARIO株式会社(以下、当社という。)がSmart7.jpのウェブサイト及びSmart7 BTアプリケーションにおいて提供する全てのサービス（以下、本サービスという。）の利用条件を定めるものです。
本サービスは、当社のコーヒーメーカーである「V60オートプアオーバーSmart7」とその関連製品の紹介や抽出レシピの共有を目的に運営しております。
本サービスを利用するにあたり、お客様は以下のご利用規約に同意したものとみなされます。 なお、ご利用規約は予告無く変更される場合がありますので、最新の内容をご確認願います。
本サービスの一部は携帯端末でご利用いただけます。注意散漫になり交通や安全に関する法律を遵守できなくなる状態で本サービスを利用しないでください。また、Smart7 BT本体から離れた場所でのご利用については、周囲の安全を確保したうえでご利用ください。

１. 定義
本利用規約において使用する用語の意義は、次に定めるとおりとします。
「利用者」とは、ユーザー登録の有無にかかわらず、本サービスを利用する全ての方をいいます。
「登録者」とは、ユーザー登録手続きを行い本サービスを利用する方をいいます。
２. ユーザー登録
本サービスはユーザー登録をせずにご利用いただくことも可能ですが、本サービスのうち特定のサービスまたは機能をご利用いただく場合にはユーザー登録が必要となります。ユーザー登録を希望する利用者は本規約に同意の上、ユーザー登録手続完了後に登録者となります。ユーザー登録手続は、ユーザーご本人が行ってください。代理による登録は一切認められません。なお、過去に登録資格が取り消された方やその当社がふさわしくないと判断した方からの登録申込についてはお断りする場合があります。
３. 登録情報の管理
登録者は、登録情報のうち本サービスへのログインに用いる情報を他人に知られることがないよう登録者本人が責任をもって管理してください。ログイン時に送信された情報が登録されたものと一致することを所定の方法により確認した場合、当該ログインを真正な登録者のログインとみなし、登録者による利用があったものとみなします。
４. 個人情報の取扱い
当社は、当社のプライバシーポリシー(https://www.hario.com/terms_of_use.html#pc)に従い、個人情報を取り扱います。
（１）お客様の個人情報の範囲
当社は以下の情報を、当社が保有するお客様の個人情報として厳重にお取扱いさせて頂きます。
ーユーザー登録の際にお預かり致しました、 メールアドレスなどの情報。
ー登録者がログイン時に使用するデバイスの情報。
（２）お客様の個人情報の利用について
当社では、以下の目的において利用させて頂きます。
ー商品開発やサービス向上のための統計データとして分析する場合。
個人情報を以上の目的以外に利用したり、お客様の同意なく第三者に情報を提供する事はありません。
（３）利用者は利用者間の識別のため、お名前（ニックネーム）及び所属、プロフィール画像等が本サイト上に表示されることに同意するものとします。
５. 登録情報の変更、ユーザー登録の解除
登録した情報に変更が生じた場合は、速やかに変更登録をお願いいたします。変更登録がなされなかったことにより生じた損害について、当社は一切責任を負いません。
登録者は、当社所定の登録解除手続きを行うことによって、ユーザー登録を解除することができます。
６. 連絡または通知
当社は、登録者への連絡または通知を、当社が適切と判断した方法により行います。なお、届出情報に含まれるメールアドレスその他の連絡先または登録者が利用している当社が提供するアプリケーションに当社の連絡または通知が到達した場合、登録者は当社の連絡または通知を受領したものとみなします。
利用者は、本利用規約に別段の定めがある場合を除き、当社への連絡はお問い合わせフォームから行うものとします。当社は電話による連絡および来訪は受け付けておりません。

７. 自己責任の原則
利用者は、利用者自身の自己責任において本サービスを利用するものとし、本サービスを利用してなされた一切の行為およびその結果についてその責任を負うものとします。
利用者は、本サービスのご利用に際し、他の利用者その他の第三者および当社に損害または不利益を与えた場合、自己の責任と費用においてこれを解決するものとします。
本サービスの一部では、ユーザーがコンテンツをアップロード、提供、保存、送信、または受信することができます。ユーザーは、そのコンテンツに対して保有する知的財産権を引き続き保持します。本サービスで表示されるコンテンツの一部は、当社の所有物ではありません。こうしたコンテンツについては、そのコンテンツを提供する当事者が単独で責任を負います。当社は、コンテンツが違法か否か、または当社のポリシーに違反しているか否かを判断するために、コンテンツをレビューすることができます。さらに、当社は、そのポリシーまたは法律に違反していると合理的に判断したコンテンツを削除したり、その表示を拒否することができます。ただし、このことは、当社がコンテンツをレビューしていることを必ずしも意味するものではありません。当社がコンテンツをレビューしていると想定しないでください。
８. 知的財産権等
利用者は、利用者が送信（発信）したコンテンツにつき、当社に対して、当社または当社の指定する者が当該コンテンツを日本国内外問わず対価の支払いなく非独占的にいかなる制約も受けずに自由に使用する（複製、公開、送信、頒布、譲渡、貸与、翻訳、翻案を含みます。）権利（サブライセンス権も含みます。）を、当該コンテンツに係る著作権その他一切の権利の存続期間が満了するまでの間、許諾したものとみなされるものとし、これをあらかじめ承諾します。利用者は当社および当社の指定する者に対して、当該コンテンツに係る著作者人格権を保有していたとしても、当該権利を行使しないものとします。
利用者が送信（発信）したコンテンツ、利用者によるサービスの利用・接続・規約違反、利用者による第三者への権利侵害に起因または関連して生じたすべてのクレームや請求について、利用者の責任と費用においてこれを解決するものとします。
利用者は、利用者が送信（発信）したコンテンツについて、当社に保存義務がないことを認識し、必要なコンテンツは適宜バックアップをとるものとします。
当社は、利用者が送信（発信）したコンテンツを、運営上必要に応じて閲覧することができ、規約に抵触すると判断した場合には、利用者への事前の通知なしに、当該コンテンツの全部または一部を非公開すること、または削除することができるものとします。
９. 当社の財産権
利用者が送信（発信）したコンテンツおよび情報を除き、本サービスに含まれる一切のコンテンツおよび情報に関する財産権は当社に帰属します。
本サービス中に掲載・提供されているコンテンツは、著作権法、商標法、意匠法等により保護されております。
本サービスおよび本サービスに関連して使用されているすべてのソフトウェアは、知的財産権に関する法令等により保護されている財産権および営業秘密を含んでおります。
１０. 禁止事項
本サービスの利用に際して、利用者に対し次の行為を行うことを禁止します。
（１）法令または本規約等に違反すること、またはその恐れのある行為
（２）当社およびその他の第三者の権利、利益、名誉等を損ねること
（３）本サービスの全部または一部を営利目的で、使用方法を問わず利用する行為
（それらの準備を目的とした行為も含みます。ただし、当社が認めた場合は除きます。）
（４）虚偽の情報を入力すること
（５）有害なコンピュータプログラム、メール等を送信または書き込むこと
（６）当社のサーバその他のコンピュータに不正にアクセスすること
（７）IDおよびパスワードを第三者に貸与・譲渡すること、または第三者と共用すること
（８）その他、当社が不適切と判断する行為
１１. 特定登録者の利用停止・登録資格取消
当社は、特定の登録者が次の各号に該当すると判断した場合には、事前に通知することなく当該登録者によるサービスの利用停止、または当該登録者の登録資格の取消しを行うことができるものとします。これにより登録者に何らかの損害が生じたとしても、当社は一切責任を負わないものとします。
（１）登録者に法令や本規約等に違反する行為があった場合
（２）登録者にサービス利用に関して不正行為があった場合
（３）その他当社が適当と判断した場合
前項のほか、登録者が当社の定める一定の期間内に一定回数のログインを行わなかった場合は、当社は、事前に通知することなく当該登録者のIDおよびパスワードの変更または登録資格の取消しを行うことができるものとします。
１２. 本サービスの中断・停止等
当社は、本サービスを常に良好な状態でご利用いただくために、システムの定期保守や緊急保守を行う場合、本サービスの運営に支障が生じると当社が判断した場合、その他必要があると判断した場合には、事前に通知することなく、本サービスの全部または一部の提供を中断または停止する等の必要な措置を取ることができるものとします。この場合に利用者に生じた損害について、当社は一切責任を負わないものとします。
１３. 本サービスの変更・廃止
当社は、その判断により本サービスの全部または一部を適宜変更・廃止できるものとします。
１４. 当社の免責
（１）通信回線やコンピュータなどの障害によるシステムの中断・遅滞・中止・データの消失、データへの不正アクセスにより生じた損害、その他当社のサービスに関して利用者に生じた損害について、当社は一切責任を負わないものとします。
（２）当社は、当社のウェブページ・サーバ・ドメインなどから送られるメール・コンテンツに、コンピューター・ウィルスなどの有害なものが含まれていないことを保証いたしません。
（３）利用者が本規約等に違反したことによって生じた損害については、当社は一切責任を負いません。
１５. 開発中のサービスについて
当社は、本サービスの一部または独立したサービスとして、開発中のサービスを提供することができるものとします。
利用者は、開発中のサービスがその性質上、バグや瑕疵、誤作動等、正常に動作しない症状等の不具合を含み得るものとして提供されることを理解するものとします。
当社は、当社が必要と判断した場合には、事前に通知することなくいつでも開発中のサービスの内容を変更し、または開発中のサービスの提供を停止もしくは中止することができるものとします。 当社は、開発中のサービスの完全性、正確性、適用性、有用性、利用可能性、安全性、確実性等につきいかなる保証も一切しません。
１６. 準拠法
本規約は、日本法に準拠し、解釈されるものとします。
１７. 利用規約の変更について
当社が必要と判断した場合には、お客様にあらかじめ通知することなくいつでも本利用規約を変更することができるものとします。

１7. 이용규약의 변경에 대해
１. 정의
본 이용규약에서 사용하는 용어의 의의는 다음과 같이 정합니다.
'이용자'란 사용자 등록의 유무와 상관 없이 본 서비스를 이용하는 모든 분을 말합니다.
'등록자'란 사용자 등록 절차를 거쳐 본 서비스를 이용하는 분을 말합니다.
２. 사용자 등록
본 서비스는 사용자 등록을 하지 않고 이용하실 수도 있지만, 본 서비스 중 특정 서비스 또는 기능을 이용하시는 경우에는 사용자 등록을 할 필요가 있습니다. 사용자 등록을 희망하는 이용자는 본 규약에 동의하신 후, 사용자 등록 절차 완료 후에 등록자가 됩니다. 사용자 등록 절차는 사용자 본인이 해 주십시오. 대리 등록은 일절 인정되지 않습니다. 또한, 과거에 등록 자격이 취소된 분이나 당사가 적합하지 않다고 판단한 분이 등록 신청을 하신 경우 거절할 경우가 있습니다.
３. 등록 정보 관리
등록자는, 등록 정보 중 본 서비스의 로그인에 이용하는 정보가 다른 사람에게 알려지는 일이 없도록 본인이 책임지고 관리해 주십시오. 로그인 시 송신된 정보가 등록된 정보와 일치함을 소정의 방법으로 확인한 경우, 해당 로그인을 정확한 등록자의 로그인으로 간주하며, 등록자의 이용이 있었다고 간주합니다.
４. 개인 정보 취급
당사는 당사의 개인정보보호정책(https://www.hario.com/terms_of_use.html#pc)에 따라 개인 정보를 취급합니다.
（１）고객 개인 정보의 범위
당사는 이하의 정보를 당사가 보유하는 고객의 개인정보로서 엄중히 취급합니다.
-사용자 등록 시 위임받은 메일주소 등의 정보.
-등록자가 로그인 시 사용하는 기기의 정보.
（２）고객 개인정보의 이용에 대해
당사에서는 이하의 목적으로 이용하고 있습니다.
-상품 개발과 서비스 향상을 위해 통계 데이터로서 분석하는 경우.
개인정보를 상기 목적 이외로 이용하거나 고객의 동의 없이 제3자에게 정보를 제공하지 않습니다.
（３）이용자는 이용자간의 식별을 위해 이름(닉네임) 및 소속, 프로필 화면 등이 본 사이트상에 표시되는 것에 동의하는 것으로 합니다.
５. 등록 정보 변경, 사용자 등록 해제
등록한 정보에 변경이 있을 경우, 신속히 변경 등록을 해 주십시오. 변경 등록이 되지 않아 발생한 손해에 대해, 당사는 일절 책임지지 않습니다.
등록자는 당사 소정의 등록 해제 절차를 거친 후 사용자 등록을 해제할 수 있습니다.

１. Definitions
The meaning of terms used in these Terms of Service shall be as prescribed below.
“User” is used to describe all users of this service, irrespective of whether or not they have registered as a user.

HARIO shall contact or notify Registered Users by the method deemed appropriate by HARIO. Furthermore, in cases where HARIO contacts or notifies Registered Users via the email address or other contact method included in the registration information, or via an application provided by HARIO which is used by the Registered User, it shall be deemed that the said contact or notification has been received by the Registered user.
Users shall contact HARIO using the Contact Us form unless otherwise indicated in these Terms of Service. HARIO shall not accept telephone calls or visits to company offices from Users.

７. Principle of Self-responsibility
Users shall use these services entirely at their own risk, and shall be fully responsible for all acts and results of said acts related to the use of these services.
In cases where a User causes damages or losses to another User, third party, or HARIO through the use of these services, the said User shall be entirely responsible to resolve the said damages or losses and cover all related costs.
In some of the services, Users are able to upload, provide, save, transmit and receive content. Users shall continue to retain all intellectual property rights to the said content. Some of the content displayed on these services does not belong to HARIO. In such cases, the parties concerned with the provision of the said content are independently responsible for the content. HARIO may review content to judge whether or not it is in violation of HARIO policies, laws, or regulations. Furthermore, in cases where HARIO reasonably judges content to be in violation of policies, laws or regulations, HARIO may delete or refuse to display the said content. However, this does not mean that HARIO reviews all content, and Users shall not assume that all content is reviewed by HARIO.
８. Intellectual Property Rights, etc.
Users are deemed to have given prior consent to grant the non-exclusive rights for the freedom of use (including duplication, publication, transmission, distribution, transfer, lending, translation and adaptation) pertaining to any and all property rights (including sub-licensing rights) of all content transmitted (sent) by the User, without limitation or request of payment, to HARIO or a party specified by HARIO, whether domestic or overseas, until expiration of the duration of the said rights. In cases where a User has the moral rights of authorship to content, the User shall not exercise these rights against HARIO or a party specified by HARIO.
In cases of complaints or demands which are caused by or related to content transmitted (sent) by the User, the use, connection to or violation of the terms of service of These Services by the User, or the infringement of the rights of a third party by the User, the said User shall be entirely responsible to resolve the said damages or losses and cover all related costs.
Users shall recognize that HARIO is not responsible for the preservation of content transmitted (sent) by the user, and the User is responsible for backing up content appropriately wherever necessary.
HARIO may view content transmitted (sent) by the User when deemed necessary for operational reasons, and in cases where the said content is judged to be in infringement of these Terms of Service, HARIO may hide or delete part or all of the said content without prior notification to the User.
９. HARIO’s Property Rights
Property rights to all of the content included in these services, with the exception of content and information transmitted (sent) by Users, shall belong to HARIO.
All content published and provided by these services is protected under copyright law, trademark law, design law and other such related laws. These services and all software used in relation to these services contain property rights and trade secrets which are protected by laws pertaining to intellectual property rights.

Users are prohibited from the following acts when using these services.

In cases where HARIO deems any of the following items applies to a specific Registered User, HARIO may suspend the use of these services or rescind registration of the said Registered User without prior notice. In such cases, HARIO shall not accept any liability whatsoever for any damages incurred by the said Registered User.
（１）Cases where the Registered User performs an act that is in violation of laws or these Terms of Service
（２）Cases where the Registered User has committed a dishonest act pertaining to use of these services
（３）Other cases that HARIO deems applicable.
In addition to the preceding paragraph, in cases where the Registered User does not log in for the number of times prescribed within the fixed period prescribed by HARIO, HARIO may change the ID or password, or cancel the registration qualifications of the said Registered User without prior notice.
